We use this information to contact you about the services on our site in which you have expressed interest.   IF YOU HAVE A DISPUTE WITH G+N OVER THE TERMS OF THIS POLICY, YOU AGREE TO SUBMIT IT TO ARBITRATION IN SAN FRANCISCO CALIFORNIA.


You have the option to provide demographic information (such as income level and gender) to us; we encourage you to submit this information so we can provide you a more personalized experience on our site. 


1.    INTRODUCTION. Growers + Nomads, LLC, (“G+N”, “us,” “we,” or “Company”) is committed to respecting YOUR privacy rights as its customer, as well as the rights of visitors, and other users of the Company Website (“the Site”). We created this Website Privacy Policy (“Privacy Policy”) to give you confidence as you visit and use the Site, and to demonstrate our commitment to fair information practices and the protection of privacy. This Privacy Policy is only applicable to the Site, and not to any other websites that you may be able to access from the Site, each of which may have data collection, storage, and use practices and policies that differ materially from this Privacy Policy.

 

1.1. Our Sensitive Information Principle: For sensitive information including your personal information specifying needs for services: G+N  will always treat as sensitive any information received from you or any third party where the third party treats and identifies it as sensitive. We may share your information only to critical parties such as those who provide contact and arrangements for your order or inquiry for services, with internal customer service reps, fulfillment and shipping providers, to allow us to send things to your point of destination, and to no others.

In order for you to access Membership or to make a Consultation Request for a FREE house [services] estimate, Request/schedule a FREE in-home consultation and estimate, to get Email Home Reminders™, or the GN Home Inspirations Newsletter™, including to our sister Brands and related products and services that we offer via the Site, we require you to provide us with certain information that personally identifies you (“Personal Information”).
    1. Personal Information includes the following categories of information: (1) Contact Data (such as your name, mailing address, and e-mail address); (2) Financial Data (such as your account or credit card number); (3) Demographic Data (such as your address for shipping zip code); (4) Rx and Prescription Data and measurements regarding your eyes, vision, vision health, and needs for our Brands and potentially, your uploaded photograph. If you communicate with us by e-mail, add favorites to the Favorites Section, or otherwise complete online forms, surveys, or provide other information, any information provided in such communication may be collected as Personal Information.
    2. COPPA STATEMENT:  We're committed to children's privacy. Protecting the privacy of the very young is important to us. for that reason:  We do not direct any part of our site or services to children under 13. We do not collect personal information from anyone under 18, we are not the operators of a general audience site that knowingly collects personal information from children under 13, and  we are not an operator of a general audience site and do not have a separate children’s area we do not collect personal information from children under 13.

3.1. COMPANY USE OF INFORMATION. We use Contact Data to send you information about our company or our products or services, or promotional material from some of our business Alliances, or to contact you when necessary. We use your Financial Data to verify your qualifications for certain products or services and to bill you for products and services. We use your Demographic Data to customize and tailor your experience on the Site, displaying content that we think you might be interested in and according to your preferences, to be sure you receive the correct order and to ship your order to you.


3.2. Sharing of Personal Information. We share certain categories of information we collect from you in the ways described in this Privacy Policy.


3.3. We do from time to time share your information with our sister companies and to some of our trading and business partner companies, as mentioned in 2.3 above. We also must share your information with those necessary to process and fulfill your membership and requests for consultations. 


  1. Our sister companies are: California Closets®, Floor Coverings International™, CertaPro® Painters, Handyman Connection®, Pillar to Post™, and College Pro Painters™.


  1. We share Contact Data and Financial Data with our sister companies and Brands, who assist us by performing core services, those that provide the Company with linking advertisements, (such as hosting, billing, fulfillment, or data storage and security vendors) related to our operation of the Site. Those business Alliances have all agreed to reasonable standards of security and confidentiality similar to those that we have promised to you in this Privacy Policy.

4.1. In addition, we maintain a procedure for you to review and request changes to your Personal Information; this procedure is described in Section called USER ABILITY TO ACCESS, UPDATE, AND CORRECT PERSONAL INFORMATION, below. NOTE that some of the services we and our Brands and some of the products used in services we and our Brands and Alliance businesses provide, may require us to share general demographic and other non-identifiable, statistical data. It is possible that some of your Personal Data might become visible to government inspectors, judges, courts and laboratories such as under a court order to supply such information, and if any of our partner businesses, Brands or services may be or become subject to, governmental and export regulations.



  1. User Choice Regarding Collection, Use, and Distribution of Personal Information. You may choose not to provide us with any Personal Information. In such an event, you can still access and use much of the Site; however you will not be able to access and use those portions of the Site that require your Personal Information, including, but not limited to, being able to order our Brands, make a purchase of any accessory or item sold from this Site or establish an account. If you do not wish to receive information and promotional material from us or from some of our Alliances, you may select the appropriate “opt-out” option each time we ask you for Personal Information.


  1. Confidentiality and Security of Personal Information. Except as otherwise provided in this Privacy Policy, we will keep your Personal Information private and will not share it with third parties, unless such disclosure is necessary to: (a) comply with a court order or other legal process; (b) protect our rights or property; or (c) enforce our Terms of Service. Your Personal Information is stored on secure servers that are not accessible by third parties. We provide you with the capability to transmit your Personal Information via secured and encrypted channels if you use a similarly equipped web browser. We may sell some of the data collected to others.


  1. USER ABILITY TO ACCESS, UPDATE, AND CORRECT PERSONAL INFORMATION, LIMITATIONS. We maintain a procedure in order to help you confirm that your Personal Information remains correct and up-to-date. Through your personal profile you may: (a) review and update your Personal Information that we have already collected; (b) choose whether or not you wish us to send you information about our company, or promotional material from some of our Alliances; and/or (c) choose whether or not you wish for us to share your Personal Information with third parties.


7.1. If you would like to remove your name and e-mail address from our database, you can send an e-mail requesting removal to info@growersandnomads.com.


7.2. Lost or Stolen Information. You must promptly notify us if your credit card, user name, or password is lost, stolen, or used without permission. In such an event, we will remove that credit card number, user name, or password from your account and update our records accordingly. You will be responsible to enter new credit information thereafter to order again.


7.3. PUBLIC INFORMATION. The Site contains links to other websites. We are not responsible for the privacy practices or the content of any websites you click to. We have no control over its use and you should exercise caution when deciding to disclose your Personal Information.


  1. Updates and Changes to Privacy Policy. We reserve the right, at any time and without notice, to add to, change, update, or modify this Privacy Policy, simply by posting such change, update, or modification on the Site and without any other notice to you. Any such change, update, or modification will be effective immediately upon posting on the Site.

If you have a dispute with this Policy or want to make a claim, first please email us at info@growersandnomads.com and if we cannot resolve your issue, we will handle our dispute in an arbitration at San Francisco, California. By using this web site you agree to use this mechanism. (see our Terms of Use).


9.1. We, as the User hereby submit to arbitration administered by The American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rues, at San Francisco, California, the controversy described herein.  We further agree that the above controversy be submitted to a single Arbitrator selected from the panels of arbitrators of the AAA.  We further agree that we will faithfully observe this agreement and the Rules and that we will abide by ad perform any award rendered by the arbitrator(s) and that judgment of the court having jurisdiction may be entered upon the award.  We agree that the award may be reviewable by the courts of California at Marin County, CA, if the arbitrator, in the opinion of any party hereto, has failed to observe the rules and laws of the State of California and perform any reward rendered by the arbitrator(s) and that a judgment of the court having jurisdiction may be entered upon the award.
